AN ACT TO AMEND SECTION 61-1-80, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REQUIREMENT THAT THE ALCOHOLIC BEVERAGE CONTROL COMMISSION IMPOSE A MONETARY PENALTY UNDER CERTAIN CONDITIONS IN LIEU OF SUSPENDING OR REVOKING A LICENSE OR PERMIT, SO AS TO MAKE THE IMPOSITION OF A MONETARY PENALTY IN LIEU OF REVOCATION OR SUSPENSION OPTIONAL RATHER THAN MANDATORY AND TO AUTHORIZE THE COMMISSION TO SUSPEND PAYMENT OF THE MONETARY PENALTY IMPOSED.

Be it enacted by the General Assembly of the State of South Carolina:

Commission may impose penalty

SECTION 1. Section 61-1-80 of the 1976 Code is amended to read:

"Section 61-1-80. The Alcoholic Beverage Control Commission may impose a monetary penalty as an alternate to revocation or suspension in all cases where the Commission has the authority to suspend or revoke a license or permit. The Commission in its discretion may also suspend payment of the monetary penalty imposed."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
