AN ACT TO AMEND SECTION 50-13-1120, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DEFINITION OF NONGAME FISHING DEVICES, TO AMEND SECTION 50-13-1115, AS AMENDED, RELATING TO DEVICES WHICH MAY BE USED TO CATCH NONGAME FISH, SO AS TO ADD PUMP NETS, AND TO AMEND SECTION 50-13-1192, AS AMENDED, RELATING TO THE NUMBER OF DEVICES WHICH MAY BE USED TO TAKE NONGAME FISH IN VARIOUS BODIES OF WATER, SO AS TO PROVIDE THAT THERE SHALL BE NO LIMIT ON THE NUMBER OF PUMP NETS WHICH MAY BE USED IN THE COOPER RIVER.

Be it enacted by the General Assembly of the State of South Carolina:

Definition

SECTION 1. Section 50-13-1120 of the 1976 Code, as last amended by Section 4 of Act 461 of 1982, is further amended by adding an appropriately lettered item to read:

"( ) 'Pump net' is a net suspended from a pole placed in a forked stick or device which may be lowered or raised manually in a seesaw type action."

Devices used to catch nongame fish

SECTION 2. Section 50-13-1115, as last amended by Act 461 of 1982, is further amended by adding at the end of subsection (A) an appropriately numbered item to read:

"( ) pump nets".

Number of devices

SECTION 3. Section 50-13-1192, as last amended by an act of 1984 bearing ratification number 352, is further amended by adding at theend of the Cooper River division of the section:

"Pump nets No limit".

Time effective

SECTION 4. This act shall take effect upon approval by the Governor.
