A JOINT RESOLUTION TO REAUTHORIZE THE EXISTENCE OF THE STATE DAIRY COMMISSION AND TO PROVIDE THAT IT SHALL NOT REGULATE THE PRICE OF MILK UNTIL THE SUPREME COURT UPHOLDS THE CONSTITUTIONALITY OF SETTING THE PRICE.

Be it enacted by the General Assembly of the State of South Carolina:

Dairy Commission reauthorized

SECTION 1. In accordance with the provisions of Section 7 of Act 608 of 1978, the existence of the State Dairy Commission is reauthorized for six years. The Dairy Commission is reauthorized with the understanding that this resolution has no effect on the court order or the appeal that is currently pending before the Supreme Court of South Carolina and that the Dairy Commission shall not attempt to regulate or otherwise set the price of milk until the Supreme Court of South Carolina upholds the constitutionality thereof.

Attorney General's office to provide legal assistance to

commission

SECTION 2. Whenever legal assistance is needed by the State Dairy Commission it must be furnished by the Attorney General's Office.

Time effective

SECTION 3. This act shall take effect upon approval by the Governor.
