A JOINT RESOLUTION TO PROVIDE THAT, IN THE EVENT A POLITICAL PARTY SHALL NOMINATE CANDIDATES BY PARTY PRIMARY ELECTION FOR THE STATE SENATE, A PARTY PRIMARY ELECTION MUST BE HELD BY THAT PARTY FOR THAT OFFICE ON THE FOURTH TUESDAY IN JULY, 1984; TO PROVIDE FOR THE REOPENING OF THE FILING PERIOD FOR SENATE OFFICES FOR CERTAIN PURPOSES UNDER CERTAIN CONDITIONS; AND TO PROVIDE THAT THE PROVISIONS OF THIS ACT ARE APPLICABLE DURING CALENDAR YEAR 1984 ONLY, AND ONLY TO ELECTIONS FOR THE STATE SENATE.

Whereas, the State of South Carolina is now seeking approval of Act 257 of 1983, a reapportionment plan for the Senate, before a three judge panel in the U.S. District Court for the District of Columbia as provided by 42 U.S.C. 1973, the Voting Rights Act of 1965, as amended; and

Whereas, party primaries for all offices are scheduled to be held on the second Tuesday in June pursuant to Section 7-13-40 of the 1976 Code, as amended, which falls on June 12, 1984; and

Whereas, the District Court for the District of Columbia has established a schedule for the disposition of the case which would require, if necessary, a trial to begin June 4, 1984; and

Whereas, the General Assembly has the responsibility to provide for the orderly conduct of party primaries and to avoid as much confusion and disruption as possible because of the proximity of the trial date and the regularly scheduled time for party primaries. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

Senate elections

SECTION 1. The provisions of this joint Resolution are applicable during the calendar year 1984 only, and only to elections for the South Carolina Senate.

Senate primary elections

SECTION 2. In the event that a party shall nominate candidates by party primary election for the South Carolina Senate, a party primary election must be held by such party for such office on the fourth Tuesday in July in 1984.

Senate elections; court approval

SECTION 3. In the event that Act 257 of 1983 is not approved by the U.S. District Court for the District of Columbia pursuant to the provisions of 42 U.S.C. 1973, the Voting Rights Act of 1965, the filing period for Senate offices shall be reopened for the entries of those candidates seeking to offer for nomination in a party primary for a time period to be determined by the General Assembly. SECTION 4. This act shall take effect upon approval of the Governor.
