AN ACT TO AMEND SECTION 50-13-1135, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO TAKING NONGAME FISH WITH FRESHWATER FISHING DEVICES, SO AS TO REQUIRE A FISHING LICENSE WHEN ONE GILL NET NO MORE THAN TWO HUNDRED YARDS IN LENGTH OR NO MORE THAN FIVE GILL NETS NONE OF WHICH EXCEEDS THIRTY YARDS IN LENGTH ARE USED, TO PROVIDE THAT A COMMERCIAL FRESHWATER FISHING LICENSE IS REQUIRED WHEN TWO OR MORE GILL NETS ARE USED BY ANY PERSON IN THE STATE'S FRESHWATERS UNLESS USED AS PERMITTED WITH ONLY A FISHING LICENSE, AND TO AMEND SECTION 50-17-1050, AS AMENDED, RELATING TO THE PROHIBITION OF PLACING STATIONARY, FIXED NETS WITHIN PRESCRIBED DISTANCES OF OTHER SUCH NETS, SO AS TO CHANGE THE SPECIFIED DISTANCE FROM TWO HUNDRED YARDS TO TWO HUNDRED FEET FOR STATIONARY OR FIXED NETS EXCEPT CHANNEL NETS WHICH MAY NOT BE SET WITHIN TWO HUNDRED YARDS OF ANY OTHER CHANNEL NET.

Be it enacted by the General Assembly of the State of South Carolina:

Gill nets

SECTION 1. Item (k) of subsection (1) of Section 50-13-1135 of the 1976 Code is amended to read:

"(k) one gill net no more than two hundred yards in length or no more than five gill nets, none of which exceeds thirty yards in length;".

Further

SECTION 2. Item (a) of subsection (2) of Section 50-13-1135 of the 1976 Code, as last amended by Act 106 of 1983, is further amended to read:

"(a) two or more gill nets unless they are used as permitted by item (k) of subsection (1);"

Stationary or fixed nets

SECTION 3. Section 50-17-1050 of the 1976 Code, as last amended by an act of 1984, bearing ratification number 383, is further amended to read:

"Section 50-17-1050. It is unlawful to place or set any stationary or fixed nets, including a gill net, fyke net, pound net, or seine within two hundred feet of any net or device previously set. It is unlawful to place or set any channel net within two hundred yards of any other channel net."

Time effective

SECTION 4. This act shall take effect upon approval by the Governor.
