AN ACT TO AMEND ACT 401 of 1978, AS AMENDED, RELATING TO THE POINT SYSTEM FOR HUNTING AND FISHING VIOLATIONS, SO AS TO PROVIDE FOR THE ASSESSMENT OF POINTS FOR VIOLATIONS INVOLVING WATERFOWL HUNTING AND TO AMEND THE 1976 CODE BY ADDING SECTION 50-11-2310 SO AS TO MAKE IT UNLAWFUL TO TRESPASS TO HUNT WATERFOWL, HUNT WATERFOWL OVER BAIT, SHOOT WATERFOWL OVER BAIT, HUNT WATERFOWL MORE THAN FIFTEEN MINUTES BEFORE OR AFTER REGULARLY DESIGNATED HUNTING HOURS, AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

Point System

SECTION 1. Subsection 2. HUNTING VIOLATIONS, of Section 1 of Act 401 of 1978, as last amended by Act 89 of 1979, is further amended by adding after item (m) the following items, to be appropriately lettered:

"( ) Trespassing to hunt waterfowl.............10

( ) Hunting waterfowl over bait...............10

( ) Shooting waterfowl over bait..............10".

Penalties

SECTION 2. The 1976 Code is amended by adding:

"Section 50-11-2310. It is unlawful for any person to:

(1) Trespass to hunt waterfowl.

(2) Hunt waterfowl over bait.

(3) Shoot waterfowl over bait.

(4) Hunt waterfowl more than fifteen minutes before or after regularly designated hunting hours.

Any person convicted of violation of the provisions of this section, possessing more than one waterfowl over the legal limit, or hunting waterfowl out of season must be fined not less than one hundred dollars or more than two hundred dollars or imprisoned for not more than thirty days. Any person convicted of violating any other hunting law involving waterfowl must be fined not less than one hundred dollars or imprisoned for not more than thirty days."

Time effective

SECTION 3. This act shall take effect upon approval by the Governor.
