A JOINT RESOLUTION TO PROVIDE FOR THE OBSERVANCE OF THE BICENTENNIAL OF THE UNITED STATES CONSTITUTION IN SOUTH CAROLINA AND TO ESTABLISH THE UNITED STATES CONSTITUTION BICENTENNIAL COMMISSION OF SOUTH CAROLINA.

Be it enacted by the General Assembly of the State of South Carolina:

Commission created

SECTION 1. There is created a United States Constitution Bicentennial Commission of South Carolina (commission) which has the authority and responsibility to plan and execute, as authorized and funded by the General Assembly, a proper observance of the Bicentennial of the Constitution of the United States in South Carolina, and in cooperation with the national Commission on the Bicentennial of the Constitution and the Constitution Commissions of other states. The commission may make such contracts as may be necessary to carry out its duties.

Staff

SECTION 2. The staff of the commission shall consist of the staffs of the Department of Archives and History and the Department of Parks, Recreation and Tourism as needed. Any persons hired or any funds appropriated for the purposes of carrying out the policies and programs of the commission must be placed in one of these two departments.

Membership

SECTION 3. Membership of the commission consists of:

(a) The Governor, ex officio,

(b) The Lieutenant Governor, ex officio,

(c) The chairman of the Archives and History Commission, ex officio,

(d) The chairman of the Parks, Recreation and Tourism Commission, ex officio,

(e) Three members to be appointed by the President of the Senate from the membership of the Senate,

(f) Three members to be appointed by the Speaker of the House of Representatives from the membership of the House,

(g) Two members to be appointed by the Governor, who shall serve one term of six years.

Officers

SECTION 4. The chairman must be appointed by the Governor from the membership of the commission whose term must be coterminous with that of the Governor. The chairman, during the term of his appointment, is also a member, ex officio, of the South Carolina Archives and History Commission, as well as the South Carolina Parks, Recreation & Tourism Commission. The vice chairman must be elected by the commission from its membership. The executive secretary of the commission is the Director of the Department of Archives and History, ex officio; and the deputy secretary of the commission is the Director of the Department of Parks, Recreation and Tourism, ex officio.

Compensation

SECTION 5. Commission members are allowed the usual mileage and subsistence as provided by law for members of state boards, committees, and commissions but the total amount may not exceed five thousand dollars per year for the entire commission.

Report

SECTION 6. The commission shall make a report to the Governor and to the General Assembly no later than June 30, 1990, stating the accomplishments and the functions that it performed during its existence. After the report is made, the commission must be dissolved no later than June 30, 1990.

Time effective

SECTION 7. This act shall take effect upon approval by the Governor.
