AN ACT TO AMEND SECTION 44-9-40, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE STATE COMMISSIONER OF MENTAL HEALTH, SO AS TO CHANGE HIS QUALIFICATION REQUIREMENTS.

Be it enacted by the General Assembly of the State of South Carolina:

Requirements of commissioner

SECTION 1. Section 44-9-40 of the 1976 Code is amended to read:

"Section 44-9-40. The Mental Health Commission shall appoint and remove a State Commissioner of Mental Health, who is the chief executive of the State Department of Mental Health. Subject to the supervision and control of the Mental Health Commission, the State Commissioner shall administer the policies and regulations established by the Commission. The State Commissioner must be a person of proven executive and administrative ability with appropriate education and substantial experience in the field of mental illness treatment. The State Commissioner must appoint and remove all other officers and employees of the State Department of Mental Health, subject to the approval of the Mental Health Commission."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
