AN ACT TO AMEND SECTION 50-17-1021, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SET AND CHANNEL NETS, SO AS TO PROVIDE THAT THE DIVISION OF MARINE RESOURCES OF THE WILDLIFE AND MARINE RESOURCES DEPARTMENT MAY EXTEND THE OPEN SEASON FOR THEIR USE BY NO MORE THAN THIRTY DAYS IN ANY YEAR.

Be it enacted by the General Assembly of the State of South Carolina:

Set traps and nets in Game Zone Nos. 6 and 11

SECTION 1. Section 50-17-1021, added to the Code by Section 3 of Act 47 of 1983, is amended to read:

"Section 3. Section 50-17-1021. It is unlawful to use set or channel nets in Game Zone Nos. 6 and 11 except in areas at times and in seasons as it is lawful to trawl for shrimp in the zones.

In Game Zone Nos. 7 and 9, it is unlawful to use set or channel nets except in those areas designated for that purpose by the Division and during the seasons when it is lawful to trawl for shrimp in the areas specified in Section 50-17-1520.

No set or channel net may be used in any of the waters of this State after November fifteenth of any year.

The Division may extend the open season for set and channel nets by no more than thirty days in any year if the action is consistent with sound fisheries management.

Finding a set or channel net aboard a boat during the closed periods specified is prima facie evidence of a violation of this Section."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
