AN ACT TO AMEND SECTIONS 50-23-90, AS AMENDED, 50-23-140, AS AMENDED, AND 50-23-210, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO TITLING OF WATERCRAFT, SO AS TO REQUIRE EITHER THE YEAR MODEL OF THE WATERCRAFT OR OUTBOARD MOTOR OR THE YEAR OF MANUFACTURE TO BE CONTAINED IN THE CERTIFICATE OF TITLE; TO REQUIRE A NOTARIZED SIGNATURE ON LIEN DISCHARGE STATEMENTS; AND TO ALLOW SUSPENSION OF A TITLE CERTIFICATE IF THE WATERCRAFT OR OUTBOARD MOTOR IS TRANSFERRED AND REGISTERED IN ANOTHER STATE.

Be it enacted by the General Assembly of the State of South Carolina:

Requirement for titling of watercraft

SECTION 1. Item 5 of subsection (a) of Section 50-23-90 of the 1976 Code is amended to read:

"(5) A description of the watercraft including its make, model, year of manufacture, or year model, registration number and manufacturer's serial number or, if none, the builder's hull number assigned to the watercraft by the Division, length, and the principal material used in construction;"

Notarized signature required

SECTION 2. Subsection (b) of Section 50-23-140 of the 1976 Code is amended to read:

"(b) When a lien is discharged, the holder shall note that fact on the face of the certificate of title over his notarized signature. Prior to delivering the certificate to the owner, the holder shall present it to the Division for the purpose of having the Division note the cancellation of his lien on the face of the certificate of title and upon the titling records of the Division."

Suspension of title

SECTION 3. Item (2) of subsection (a) of Section 50-23-210 of the 1976 Code is amended to read:

"(2) The watercraft, or outboard motor, has been scrapped, dismantled, or destroyed, or transferred and registered in another state."

Time effective

SECTION 4. This act shall take effect upon approval by the Governor.
