AN ACT TO AMEND SECTIONS 50-19-2810, 50-19-2820, 50-19-2830, 50-11-986, AND 50-13-700, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO GAME ZONE NO. 6, SO AS TO CHANGE REFERENCES TO GAME ZONE NO. 6 TO GAME ZONE NO. 11 AND TO PROVIDE THAT THE METHOD OF TAKING GAME IN GAME ZONE NO. 11 MUST BE THE SAME AS FOR GAME ZONE NO. 6 AND TO REGULATE THE USE OF DRAG SEINES OR DRAG NETS IN ANY WATERS IN BEAUFORT COUNTY IN GAME ZONE NO. 11 AND TO REPEAL SECTION 50-19-2860, RELATING TO EXCEPTIONS TO GIGGING REGULATIONS IN BERKELEY AND CHARLESTON COUNTIES.

Be it enacted by the General Assembly of the State of South Carolina:

Nonresident's gigging license

SECTION 1. Section 50-19-2810 of the 1976 Code is amended to read: "Section 50-19-2810. All nonresidents of this State, before gigging for fish in the salt waters in Game Zone No. 11, shall first procure a nonresident gigging license, the fee for which is twenty-five dollars and twenty-five cents. Any person violating the provisions of this section, upon conviction, must be punished by a fine of not less than fifty dollars or imprisonment for not less than thirty days for the first offense. The fine or imprisonment for each subsequent violation must be double the amount of the previous fines and imprisonments imposed upon the violator."

Resident's gigging license

SECTION 2. Section 50-19-2820 of the 1976 Code is amended to read: "Section 50-19-2820. All residents of this State or freeholders of the counties within the zone, before gigging for fish in the salt waters in Game Zone No. 11, shall procure a resident gigging license, the fee for which is one dollar and ten cents.

Any person violating the provision of this section, upon conviction, must be punished by a fine of not less than ten dollars or imprisoned for a period of not less than ten days for the first offense. The fine or imprisonment for each subsequent offense must be double that previously imposed against the violator."

Procurement of license

SECTION 3. Section 50-19-2830 of the 1976 Code is amended to read: "Section 50-19-2830. The license must be procured from any county treasurer within Game Zone No. 11, his designated agents or any authorized official of the South Carolina Wildlife and Marine Resources Commission."

Open and close seasons

SECTION 4. Section 50-11-986 of the 1976 Code, added by Section 2 of Act 274 of 1982, is amended to read:

"Section 50-11-986. The open and closed seasons for the hunting of game and the methods of taking game in Game Zone 11 are the same as for Game Zone 6."

Penalty

SECTION 5. Section 50-13-700 of the 1976 Code is amended to read:

"Section 50-13-700. It is unlawful for any person to use or have in possession any drag seine or drag net more than four hundred feet long or more than twelve feet deep with mesh smaller than one and one-half inches in any waters in Beaufort County in Game Zone No. 11. Any person violating any of the provisions of this section is subject to a fine of not less than fifty dollars nor more than one hundred dollars or to imprisonment not exceeding thirty days for the first offense, and for a second or subsequent offense, must be fined not less than five hundred dollars nor more than one thousand dollars or imprisoned for not less than sixty days nor more than six months, or both fine and imprisonment, in the discretion of the court."

Repeal

SECTION 6. Section 50-19-2860 of the 1976 Code is repealed.

Time effective

SECTION 7. This act shall take effect upon approval by the Governor.
