AN ACT TO AMEND SECTION 50-17-2110, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO TAKING SHAD, SO AS TO ALLOW THE USE OF GILL NETS FOR TAKING SHAD IN THE SANTEE RIVER AND ITS TRIBUTARIES UPSTREAM FROM S. C. HIGHWAY 41 TO S. C. HIGHWAY 52 TWO DAYS A WEEK DURING THE SHAD SEASON AND TO EMPOWER THE EXECUTIVE DIRECTOR OF THE WILDLIFE AND MARINE RESOURCES DEPARTMENT TO PROHIBIT THE USE OF GILL NETS IN THE AREA IF HE DETERMINES THAT IT IS HAZARDOUS TO STRIPED BASS FISHERY.

Be it enacted by the General Assembly of the State of South Carolina:

Shad season, gill nets, Santee River

SECTION 1. Item (6) of Section 50-17-2110 of the 1976 Code, added by Act 322 of 1984, is amended to read:

"(6) No shad may be taken by gill net in the Santee River or any of its tributaries upstream from S. C. Highway 41; except that on Tuesday and Thursday of one week and Wednesday and Friday of the following week, alternately, shad may be taken by gill net in the Santee River and its tributaries upstream from S. C. Highway 41 to S. C. Highway 52. If the taking of shad between Highways 41 and 52 is determined to be hazardous to the striped bass fishery by theexecutive director of the Wildlife and Marine Resources Department, he may by emergency regulation close the waters to shad fishing."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
