AN ACT TO AMEND SECTION 50-13-735, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE TAKING OF GIZZARD SHAD, THREADFIN SHAD, AND HERRING IN THE SANTEE RIVER AND ITS TRIBUTARIES IN GAME ZONE NO. 9 AND BERKELEY COUNTY SO AS TO CHANGE THE OPEN SEASON FROM FEBRUARY FIFTEENTH TO APRIL FIRST TO FROM FEBRUARY FIFTEENTH TO MAY FIRST AND TO AMEND SECTION 50-13-1170, SO AS TO PROVIDE THAT NONGAME FISH CAUGHT IN LICENSED SHAD NETS LAWFULLY FISHED DURING THE OPEN SEASON FOR TAKING SHAD MAY BE KEPT BY THE FISHERMAN.

Be it enacted by the General Assembly of the State of South Carolina:

Taking herring in the Santee River

SECTION 1. Item (5) of Section 50-13-735 of the 1976 Code added by Act 321 of 1984, is further amended to read:

"(5) The season for taking herring in the Santee River with the above-described gear is from February fifteenth to May first from sunrise Mondays until sunset Thursdays only."

Nongame fish may be kept

SECTION 2. Section 50-13-1170 of the 1976 Code is amended by adding at the end:

"Nongame fish caught in licensed shad nets lawfully fished during the open season for taking shad may be kept by the fisherman."

Time effective

SECTION 3. This act shall take effect upon approval by the Governor.
