AN ACT TO AMEND ACT 848 OF 1946, AND ACT 343 OF 1971, BOTH AS AMENDED, RELATING TO THE UNION HOSPITAL DISTRICT AND THE UNION RECREATION DISTRICT SO AS TO PROVIDE THAT THE MEMBERS OF THE GOVERNING BODIES OF THE DISTRICTS MUST BE APPOINTED BY THE UNION COUNTY COUNCIL INSTEAD OF BY THE GOVERNOR AND TO PROVIDE THAT THE UNION COUNTY COUNCIL SHALL ESTABLISH THE MEMBERS' TERMS OF OFFICE.

Be it enacted by the General Assembly of the State of South Carolina:

Union Hospital District, board of trustees, etc.

SECTION 1. Section 2 of Act 848 of 1946 is amended to read:

"Section 2. The Union Hospital District is governed by a Board composed of seven members, known as the Union Hospital District Board of Trustees. Three of the members of the Board of Trustees must be medical doctors and practicing physicians within the Union Hospital District and four of the members must be resident citizens of that District. The members of the Board of Trustees must be appointed by the Union County Council which also shall establish the terms of the members. Any vacancy occurring in the office of trustee must be filled in the manner of the original appointment for the unexpired portion of term. Upon appointment the members of the Board of Trustees shall qualify by taking the oath required of other officers of the State, and organize by the election of one of their members as chairman and one as secretary, and by the election of other officers they consider necessary, but no bonds are required of them. The treasurer of Union County is the treasurer of the Union Hospital District Board of Trustees. He shall receive and pay out all moneys under the control of the board as directed by it, but shall receive no compensation for his services. No trustee shall receive compensation for his services, but may receive reimbursement for any cash expenditures actually made for personal expenses incurred as trustee. The Union Hospital District Board of Trustees shall adopt an official seal and procure office quarters within the Union Hospital District where all formal meetings must be held, and all records must be kept."

Appointment of commission members, vacancies, etc.

SECTION 2. Section 4 of Act 343 of 1971 as last amended by Act 507 of 1976 is further amended to read:

"Section 4. The district is governed by an eight member commission appointed by the Union County Council for terms to be determined by the Council.

Vacancies on the commission must be filled in the manner of the original appointment for the unexpired portion of the term.

The commission shall organize by electing one of its number as chairman, a second as vice chairman, a third as secretary and a fourth as treasurer. The officers of the commission shall hold office for terms of one year and until their successors are elected. It is the duty of the commission to furnish a record of the appointees and their terms to the clerk of court to be filed in his office. No member of the commission shall receive any compensation for his services as a member of the commission."

Time effective

SECTION 3. This act shall take effect upon approval by the Governor.
