AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-11-617 SO AS TO MAKE IT UNLAWFUL TO CULTIVATE OR ATTEMPT TO CULTIVATE MARIJUANA ON THE LAND OF ANOTHER, TO LIMIT THIS OFFENSE TO CASES WHERE AT LEAST TWENTY-FIVE PLANTS ARE CULTIVATED, AND TO PROVIDE A PENALTY.

Be it enacted by the General Assembly of the State of South Carolina:

Unlawful to cultivate or attempt to cultivate

marijuana

SECTION 1. Article 7, Chapter 11, Title 16 of the 1976 Code is amended by adding:

"Section 16-11-617. It is unlawful for any person to enter on the land of another for the purpose of cultivating or attempting to cultivate marijuana. The provisions of this section are cumulative and not in lieu of any other provisions of law. To constitute a violation of this section a minimum of twenty-five marijuana plants must be cultivated. Any person violating the provisions of this section is guilty of a misdemeanor and upon conviction must be imprisoned for not more than five years and fined not more than five thousand dollars."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
