AN ACT TO AMEND SECTION 50-11-2640, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE DESIGNATION OF THE HIGHLANDS OF FRIPP ISLAND IN BEAUFORT COUNTY AS A BIRD AND GAME SANCTUARY, SO AS TO PROVIDE FOR THE TAKING OF WILDLIFE IN THE SANCTUARY IF THE WILDLIFE IS FOUND TO CONSTITUTE A NUISANCE OR THREAT TO HUMAN HEALTH AND WELFARE AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

Bird and game sanctuary designated

SECTION 1. Section 50-11-2640 of the 1976 Code is amended to read:

"Section 50-11-2640. The highlands of Fripp Island in Beaufort County are designated as a bird and game sanctuary, and it is unlawful for any person to trap, hunt, molest, or attempt to molest in any manner any bird, wild fowl, or game within the sanctuary.

On receipt of complaints by residents who reside in the above-described area the Executive Director of the Department of Wildlife and Marine Resources shall conduct a study to determine whether or not wildlife within the sanctuary constitutes a nuisance or a threat to human health and welfare.

If it is determined that the wildlife does constitute a nuisance or threat the Executive Director may authorize the taking of wildlife within the sanctuary and prescribe the species of animal, the number of animals which may be taken, and the method by which they may be taken. The taking of any animal under this section must be accomplished under the supervision of a commissioned representative of the department.

Any person violating the provisions of this section is guilty of a misdemeanor and upon conviction must be fined not more than one hundred dollars or be imprisoned for not more than thirty days."

SECTION 2. This act shall take effect upon approval by the Governor.
