AN ACT TO AMEND SECTION 44-6-150, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE CREATION OF THE SOUTH CAROLINA MEDICALLY INDIGENT ASSISTANCE FUND, SO AS TO REPLACE PER CAPITA INCOME WITH PERSONAL INCOME AS ONE OF THE FACTORS WHICH MUST BE USED IN COMPUTING EACH COUNTY'S ASSESSMENT TO THE FUND, TO SPECIFY, FOR FISCAL YEAR 1985-86 ONLY, THE AMOUNT OF EACH COUNTY'S CONTRIBUTION TO THE FUND, AND TO MAKE THE PROVISIONS OF THIS ACT RETROACTIVE TO THE EFFECTIVE DATE OF SECTION 19 OF PART II OF ACT 201 OF 1985.

Be it enacted by the General Assembly of the State of South Carolina:

County assessment; formula

SECTION 1. The first paragraph of subsection (C) of Section 44-6-150, as added by subsection (C) of Section 19 of Part II of Act 201 of 1985, is amended to read:

"(C) For the first two years, each county is assessed its portion for the Medically Indigent Assistance Fund based on a formula which equally weighs the following factors in each county: property value, personal income, and net taxable sales. For the third and subsequent years, each county will be assessed its portion for the Medically Indigent Assistance Fund based on a formula which equally weighs the following factors in each county: property value, personal income, net taxable sales, and the previous two years of claims against the fund by county residences. If a trust fund has been established in a county to fund indigent care in the county, contributions to the Medically Indigent Assistance Fund from the trust fund on behalf of the county must be credited against the county assessment."

SECTION 2. For fiscal year 1985-86 only, the following is the amount of each county's contribution for the Medically Indigent Assistance Act, as calculated pursuant to the provisions of Section 44-6-150 of the 1976 Code, as amended by the provisions of Section 1 of this act:

Retroactive effect

SECTION 3. The provisions of this act are retroactive to June 20, 1985, the effective date of Section 19 of Part II of Act 201 of 1985.

Time effective

SECTION 4. This act shall take effect upon approval by the Governor.
