AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 42-15-55 TO ALLOW A JUDGE OF PROBATE, CLERK OF COURT, MASTER, CIRCUIT JUDGE, OR A MEMBER OF THE WORKERS' COMPENSATION COMMISSION TO APPOINT A GUARDIAN AD LITEM FOR A MINOR OR MENTALLY INCOMPETENT PERSON WHO IS A PARTY IN A PROCEEDING BEFORE THE WORKERS' COMPENSATION COMMISSION.

Be it enacted by the General Assembly of the State of South Carolina:

Minor or mentally incompetent person

SECTION 1. The 1976 Code is amended by adding:

"Section 42-15-55. When a minor or mentally incompetent person is a party in a proceeding before the Workers' Compensation Commission of this State a guardian ad litem for the minor or mentally incompetent person may be appointed by a judge of probate, clerk of court, or master, if there is a master, of the county where the minor or mentally incompetent person resides or by any circuit judge or a member of the Workers' Compensation Commission."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
