AN ACT TO AMEND SECTION 20-7-1710, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE REQUIREMENT FOR WRITTEN CONSENT TO ADOPTIONS, SO AS TO PROVIDE THAT IF AN AGENCY HAVING CUSTODY OF A CHILD REFUSES TO GRANT CONSENT TO AN ADOPTION, THE PERSONS SEEKING THE ADOPTION MUST BE INFORMED OF ALL THEIR RIGHTS FOR JUDICIAL REVIEW.

Be it enacted by the General Assembly of the State of South Carolina:

Consent

SECTION 1. Section 20-7-1710, as last amended by Act 474 of 1984, is further amended by adding at the end:

"If the consent of an agency required by item (d) of this section is not provided to persons eligible under Section 20-7-1670, the agency has an affirmative duty to inform persons who are denied consent to adoption of all their rights for judicial review of the denial."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
