AN ACT TO AMEND ACT 245 OF 1983, AS AMENDED, RELATING TO BUDGETS OF SCHOOL DISTRICTS IN ORANGEBURG COUNTY, SO AS TO PROVIDE THAT TAX MILLAGE MAY BE INCREASED BY NO MORE THAN FIVE MILLS OR TO MEET SOUTH CAROLINA EDUCATIONAL IMPROVEMENT ACT OF 1984 REQUIREMENTS WITHOUT A REFERENDUM, AND TO REQUIRE A REFERENDUM IF THE INCREASE EXCEEDS FIVE MILLS OR THOSE REQUIREMENTS AND TO PROVIDE THAT ORANGEBURG COUNTY SCHOOL DISTRICT NUMBER SIX MAY ADD MILLAGE FOR THE 1984-1985 FISCAL YEAR WITHOUT A REFERENDUM.

Be it enacted by the General Assembly of the State of South Carolina:

Budget to be prepared

SECTION 1. Section 1 of Act 245 of 1983, as last amended by an act of 1985 bearing Ratification Number 66, is further amended to read:

"Section 1. The Board of Trustees of each of the school districts in Orangeburg County, on or before the last day of June of 1985, shall prepare a school district budget for the ensuing school year. On or before the first day of September of 1985 each board of trustees shall notify the county auditor and treasurer in writing of the millage required for the operation of the schools in their respective districts for the 1985-1986 school year. The notice by each board constitutes authority for the levying and collection of the millage upon all of the real and personal property within the respective school district. The levy must be placed to the credit of the district in which it is levied and expended within that district only. A district may increase its millage by no more than five mills or the amount needed to meet its requirements under the South Carolina Educational Improvement Act of 1984, without a referendum. In addition to the millage increase allowed by this section without a referendum, Orangeburg County School District Number Six, may, without a referendum, add millage sufficient to cover its operating deficit for the fiscal year ending June 30, 1985, and the notes and bonds issued to fund such deficit. No district may raise its millage by more than five mills or to exceed its South Carolina Educational Improvement Act of 1984 requirements unless a majority of the registered electors of the district voting in a referendum called by the district Board of Trustees and conducted by the County Election Commission, vote in favor of the millage increase budget becoming effective. No referendum is required to add millage sufficient for Orangeburg County School District Number 6 to cover any operating deficit for the fiscal year ending June 30, 1985, and the notes and bonds issued to meet such deficit."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
