AN ACT TO AMEND ACT 784 OF 1964, AS AMENDED, RELATING TO THE LUGOFF WATER DISTRICT OF KERSHAW COUNTY SO AS TO REVISE THE SERVICE AREA OF THE DISTRICT AND TO DELETE A PORTION OF THE SERVICE AREA FROM THE CHARLOTTE-THOMPSON WATER DISTRICT IN KERSHAW COUNTY.

Be it enacted by the General Assembly of the State of South Carolina:

Service area added to district

SECTION 1. Act 784 of 1964, as last amended by Act 418 of 1971, is further amended by adding:

"Section 2A. In addition to the service area of the Lugoff Water District described in Section 2 of this act, the following described areas are added to the service area of the district:

From a point 500 feet south of the intersection of State Road 34 and the intersection of the Fairfield County line, which is the boundary described in Act 418 of 1971, thence eastward to a point 500 feet west of State Road 21, thence extending in a south and southeasterly direction 500 feet parallel to and southwest of Highway 21 to the point where the transmission line of the natural gas company crosses 500 feet southwest of Highway 21, thence turning and following the right-of-way of the natural gas line in a generally easterly direction to its intersection with the present boundary of Lugoff Water District, which is 500 feet west of a road connecting Highway 34 and Highway 349, thence along the existing boundary line of Lugoff Water District to the point 500 feet southwest of Highway 34, thence parallel to Highway 34 and 500 feet southwesterly therefrom to the point of beginning near the Fairfield County line.

Also, that territory beginning at a point 500 feet northwest of Highway 752 and 500 feet north of the Seaboard Coastline Railroad, thence running in a southwesterly direction parallel to and 500 feet north of the Seaboard Coastline Railroad to a point 500 feet southwest of Highway 700, thence turning in a southeasterly direction parallel to and 500 feet from Highway 700 to its intersection with Highway 756, thence turning and running westerly parallel to and north of Highway 756 a distance of one mile, more or less, thence turning in a southerly direction and following the branch of Hagins Creek to its intersection with the Frontage Road on the northwest side of I-20, thence extending southwestwardly 500 feet north of the Frontage Road to a point 500 feet southwest of its intersection with Highway 47, thence turning in a southeasterly direction and extending from this point across I-20 to a point remaining 500 feet southeast of Highway 12, thence extending northeastwardly 500 feet south of Highway 12 to a point 500 feet southwest of Highway 47, thence extending southeasterly parallel to and 500 feet southwest of Highway 47 to its intersection with Highway 601, thence continuing on southeasterly beyond Highway 601 to a point 500 feet southeast of the intersection of Highway 47 and Highway 405, thence paralleling Highway 405 and 500 feet south of the south side thereof to its approximate intersection with Spears Creek, thence following Spears Creek south to its intersection with Raglin Creek, thence following Raglin Creek in an easterly direction to its intersection with the Wateree River, thence in a northerly direction along the Wateree River to its intersection with the present boundary line which is the intersection of Gillis Ditch and the Wateree River, thence following the course of Gillis Ditch in a westerly direction to a point approximately 1 mile east of Highway 601, thence turning and going westerly across Highway 601, Highway 12 and I-20 to a point 500 feet west of Highway 752, thence paralleling Highway 752 in a northerly direction 500 feet westerly therefrom to the point of beginning 500 feet northwest of the Seaboard Coastline Railroad.

All of the above are more particularly shown on a drawing thereof attached hereto and marked new area."

Service area deleted from district

SECTION 2. The following described area of the Charlotte-Thompson Water District is deleted from the service area of the district:

Beginning at a point at the southeast quadrant of the intersection of Highway 46 with Highway 34, thence extending in a generally southerly direction along the eastern side of Highway 46, also known as Precipice Road to a point opposite the Northern boundary line of Hermitage Mobile Home Park, thence extending in a westerly direction along the property line of Hermitage Mobile Home Park and encompassing the property of Hermitage Mobile Home Park to the south and thence back to the east intersecting with the Precipice Road, thence extending on in an easterly direction across Precipice Road with the property line being extension of the southern property line of Hermitage Mobile Home Park, said line to extend on to a point 300 feet west of Highway #329, thence in a southerly direction along the west side of Highway #329 to a point 500 feet north of the intersection of Highway #329 with Interstate 20, thence extending eastwardly remaining 500 feet parallel along the northern side of Interstate 20 to a point on the eastern bank of Swift Creek, thence following the eastern bank of Swift Creek in a generally southerly direction to its intersection with Little Swift Creek, thence in a generally southwestwardly direction along the southern bank of Little Swift Creek to its intersection with a branch of the creek which extends southeastwardly across the Sumter County line, said line continuing to the intersection with the Kershaw-Sumter County line, thence in a northeasterly direction along the Kershaw-Sumter County line to its intersection with Lee County, thence continuing along the same county line between Kershaw and Lee Counties to its intersection with Highway 787, thence in a westerly direction along the south side of Highway 787, to its intersection with Highway 562, thence in a northerly direction along Highway 562, crossing I-20 to the northwestern corner of the intersection of Highways 562 and 90, thence following along Highway 90 the existing boundary line of Cassatt Water Company in a generally northwesterly direction to Highway 34 and continuing along the Cassatt Water Company present boundary line on Highway 34 in a westerly direction to the point of beginning at Highway #46.

Time effective

SECTION 3. This act shall take effect upon approval by the Governor.
