AN ACT TO PROVIDE FOR THE ELECTION OF THE NEWBERRY COUNTY BOARD OF EDUCATION FROM THE DISTRICTS FROM WHICH THE MEMBERS OF THE NEWBERRY COUNTY COUNCIL ARE ELECTED, TO ALLOW THE PRESENT BOARD MEMBERS TO SERVE UNTIL THEIR TERMS EXPIRE EXCEPT WHEN A SPECIAL ELECTION IS REQUIRED, TO PROVIDE FOR A SPECIAL ELECTION IF ANY DISTRICT HAS NO RESIDENT WHO IS A PRESENT BOARD MEMBER OR IF ANY DISTRICT HAS MORE THAN ONE RESIDENT WHO IS A PRESENT BOARD MEMBER, TO PROVIDE FOR FILLING OF VACANCIES, TO PROVIDE THAT NO PERSON EMPLOYED IN THE PUBLIC SCHOOL SYSTEM IS ELIGIBLE TO SERVE AS A BOARD MEMBER, TO PROVIDE FOR MEETINGS AND COMPENSATION, TO PROVIDE FOR THE PRESENT CHAIRMAN AND OFFICERS TO CONTINUE TO SERVE, AND TO DELETE SECTIONS 1 AND 2 OF ACT 981 OF 1972, RELATING TO THE NEWBERRY COUNTY BOARD OF EDUCATION.

Be it enacted by the General Assembly of the State of South Carolina:

Board of Education in Newberry County

SECTION 1. In Newberry County the county board of education must be composed of seven qualified persons to be elected as follows:

One member of the board must be elected from each of the seven single-member election districts provided for in Section 2 of this act by the qualified electors of the district for a term of four years and until a successor is elected and qualifies. The members of the board must be residents of their respective districts.

Districts

SECTION 2. The districts from which the members of the county board of education must be elected are the same seven geographical districts from which members of the Newberry County Council are elected and having the same number designation.

Present members

SECTION 3. The present members of the Newberry County Board of Education shall continue to serve until their respective terms expire, except as provided in Section 4 of this act. After their respective terms expire, they or their successors must be elected for terms of four years in the manner provided by law.

Special election required

SECTION 4. If any district created by this act, which has been approved by the United States Department of Justice pursuant to the Federal Voting Rights Act of 1965, has no resident who is a present member of the board, a special election must be held in the manner provided by law for the election of a member of the board from that district for an initial term to commence the Monday next following the election and to expire in 1990. Commencing with the general election of 1990, the member from that district must be elected for a term of four years. If any district created by this act, which has been approved by the United States Department of Justice, has more than one resident who is a present member of the board, a special election must be held in the manner provided by law for the election of a single member of the board from that district for an initial term to commence the Monday next following the election and to expire in 1990. Commencing with the general election of 1990, the member from that district must be elected for a term of four years.

The special election provided for in this section must be held within one hundred twenty days after approval by the United States Department of Justice. Parties may nominate candidates for the special election in the manner provided by law. Candidates must be nominated within sixty days prior to the special election.

The county commissioners of election shall conduct and supervise the special election in the manner governed by the election laws of this State, mutatis mutandi. The commissioners shall prepare the necessary ballots, appoint managers for the voting precincts, and do all things necessary to carry out the election, including the counting of ballots and declaring the results of the election. The commissioners shall advertise the date of the special election thirty days preceding the election in a newspaper of general circulation published in the county, and if a party primary is held, the date of the primary must be advertised two weeks before the primary. The costs of the election must be borne by the district.

Vacancies

SECTION 5. Any vacancy must be filled for the unexpired portion of the term by appointment of the Governor upon recommendation of the county legislative delegation. If the unexpired portion exceeds two years the appointed member serves until the next general election at which time a successor must be elected for the remaining portion of the term.

No person employed in the public school system is eligible to serve as a member of the board. The board shall meet at least once each month and at other times as it sees fit. As compensation for their services each member shall receive one thousand two hundred dollars annually.

The chairman and officers now serving in those capacities shall continue to so serve until their successors are elected by the board.

Sections deleted

SECTION 6. Sections 1 and 2 of Act 981 of 1972 are deleted.

Time effective

SECTION 7. This act shall take effect upon approval by the Governor.
