AN ACT AMEND SECTION 38-9-310, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE OFFENSE OF KNOWINGLY PRESENTING FALSE CLAIMS TO AN INSURANCE COMPANY FOR PAYMENT, SO AS TO MAKE IT UNLAWFUL TO KNOWINGLY ASSIST OR CONSPIRE WITH ANOTHER TO PRESENT A FALSE CLAIM TO AN INSURANCE COMPANY FOR PAYMENT AND TO CHANGE THE PENALTY FROM A FINE OR IMPRISONMENT IN THE DISCRETION OF THE COURT TO IMPRISONMENT FOR NOT MORE THAN FIVE YEARS OR A FINE OF NOT MORE THAN FIVE THOUSAND DOLLARS, OR BOTH.

Be it enacted by the General Assembly of the State of South Carolina:

Penalty

SECTION 1. Section 38-9-310 of the 1976 Code is amended to read:

"Section 38-9-310. Any person who knowingly causes to be presented to any insurance company transacting business in this State a false claim for payment, or who knowingly assists, solicits, or conspires with another to present a false claim for payment, is guilty of a misdemeanor and, upon conviction, must be imprisoned for not more than five years or fined not more than five thousand dollars, or both."

Time effective

SECTION 2. This act shall take effect upon approval by the Governor.
