AN ACT TO PROVIDE FOR THE ELECTION OF THE MEMBERS OF THE BOARDS OF TRUSTEES OF LAURENS COUNTY SCHOOL DISTRICTS 55 AND 56, ESTABLISH SINGLE-MEMBER ELECTION DISTRICTS FOR MEMBERS OF THE BOARD, PROVIDE THAT THESE ELECTIONS MUST BE NONPARTISAN, PROVIDE THE MANNER IN WHICH THE MEMBERS OF THESE BOARDS ARE ELECTED, PROVIDE FOR THE MANNER IN WHICH THESE NONPARTISAN ELECTIONS MUST BE CONDUCTED, ABOLISH THE LAURENS COUNTY BOARD OF EDUCATION AND DEVOLVE ITS DUTIES, POWERS, AND RESPONSIBILITIES UPON THE SCHOOL DISTRICTS IN THE COUNTY, EXCEPT THOSE FUNCTIONS REGARDING THE ELECTION PROCESS OF THE TRUSTEES OF THE DISTRICTS; AND REPEAL ACTS 276 AND 277 OF 1987 RELATING TO THE ELECTION FROM DEFINED SINGLE-MEMBER DISTRICTS OF MEMBERS OF BOARDS OF TRUSTEES OF SCHOOL DISTRICTS 55 AND 56 IN LAURENS COUNTY.
Be it enacted by the General Assembly of the State of South Carolina:
Election of Trustees - District 55
SECTION 1. (A) The members of the Board of Trustees of Laurens County School District 55 must be elected in nonpartisan elections to be conducted in the manner provided in this section. These nonpartisan elections must be held at those times specified by this act.
(B) One member of the Board of Trustees of School District 55 of Laurens County must reside in and be elected from each of the following defined single-member election districts by the electors within each election district:

(C) The members of the board elected from defined single-member election districts must be residents of those election districts and must be elected by the qualified electors of those election districts. The chairman of the board must be elected from the membership of the board by a majority vote of the board for a term of two years and until his successor is elected and qualifies. All persons desiring to qualify as a candidate and be elected to the board shall file a petition signed by no fewer than twelve qualified electors who reside in the district in which the candidate intends to run. The petition must be filed with the county election commission by twelve o'clock noon at least three weeks before the date set for the election. This petition must include the candidate's name, single-member election district of residence, and other information as the county election commission requires.
(D) The county election commission shall conduct and supervise the elections for members of the board in the manner governed by the election laws of this State mutatis mutandi. The county election commission shall prepare the necessary ballots, appoint managers for the voting precincts, and do all things necessary to carry out the elections, including the counting of ballots and declaring the results of the election. The county election commission shall give notice of the time and purpose of the election by advertisement in a newspaper having general circulation in the county in at least two weekly issues immediately preceding the date of the election. The costs of the election must be borne by the district.
(E) The result of the election must be determined in accordance with the nonpartisan plurality method prescribed by Section 5-15-61 of the 1976 Code.
(F) An election to elect a school board trustee must be held on the first Tuesday in March 1989, by the Laurens County Election Commission in Laurens County School District 55, Election Districts 3, 6, and 7 as described in this section. The trustees elected in each district shall take office on April 1, 1989, and shall serve a four-year term. Thereafter, successors must be elected for regular four-year terms at elections to be held on the first Tuesday in March of the appropriate year to take office on April first.
(G) The members of the Board of Trustees of School District 55 of Laurens County who were elected from Districts 1, 2, 4, and 5, as described in this section, on March 1, 1988, shall continue to serve until their successors are elected and qualify on the first Tuesday in March 1991, and each four years thereafter. Their successors shall serve regular terms of four years.
Election of Trustees - District 56
SECTION 2. (A) The members of the Board of Trustees of Laurens County School District 56 must be elected in nonpartisan elections to be conducted in the manner provided in this section. These nonpartisan elections must be held at those times specified by this act.
(B) One member of the Board of Trustees of School District 56 of Laurens County must reside in and be elected from each of the following defined single-member election districts by the electors within each election district:

Board of Education abolished
SECTION 3. The Laurens County Board of Education is abolished on July 1, 1988. All duties, powers, and responsibilities of the board, except those regarding the election process of the trustees of the districts, are transferred to the two districts in Laurens County.
Repealed
SECTION 4. Acts 276 and 277 of 1987 are repealed.
Time effective
SECTION 5. This act takes effect upon approval by the Governor.
