AN ACT TO AMEND ACT 470 OF 1971, AS AMENDED, RELATING TO THE VOCATIONAL EDUCATION SCHOOL FOR SUMTER COUNTY, SO AS TO PROVIDE THAT TWO MEMBERS OF THE CAREER CENTER BOARD OF TRUSTEES MUST BE APPOINTED BY THE SUMTER COUNTY LEGISLATIVE DELEGATION, TO REQUIRE THE IMMEDIATE APPOINTMENT OF A SUCCESSOR TO A MEMBER OF THE CAREER CENTER BOARD UPON THE EXPIRATION OF HIS TERM, TO DELETE REFERENCES TO NONEXISTENT BOARDS AND COMMISSIONS AND TO REPLACE THEM WITH THEIR PRESENT COUNTERPARTS, TO PROVIDE FOR DIRECTOR OF THE CAREER CENTER TO ACT AS SUPERVISOR AND FISCAL AGENT FOR THE SCHOOL, TO PROVIDE FOR EQUAL EQUITY IN SCHOOL PROPERTY BY SCHOOL DISTRICTS 2 AND 17 OF SUMTER COUNTY, AND TO DELETE REQUIREMENTS FOR APPROVAL OF TAX LEVIES MADE FOR THE SCHOOL BY THE COUNTY GOVERNING BODY.

Be it enacted by the General Assembly of the State of South Carolina:

Vocational Education - Sumter County

SECTION 1. Act 470 of 1971, as last amended by Act 1256 of 1974, is further amended to read:

"Section 1. There is created a Vocational Education School for Sumter County, to teach young people and young adults trades and occupations needful, necessary, or advantageous to them in furthering their standard of living and providing a livelihood for themselves and their dependents.

Section 2. The board of trustees of the Career Center (the board) consists of two members each from the school boards of School Districts 17 and 2, to be designated by the respective boards, and two members to be appointed by the Sumter County Legislative Delegation to serve for terms of two years. Upon the expiration of the term of one member from each district first occurring after the effective date of this act his successor must be appointed by the Sumter County Legislative Delegation. The terms of the members selected by the school board must be coterminous with their terms on the board which selects them. All members shall serve until their successors are selected which must be upon the expiration of their terms. The secretary of each board shall certify to the board the names of the persons selected, and a record must be kept in the office of the selections.

Section 3. A chairman, vice-chairman, and a secretary must be elected annually. The board shall meet regularly once a month unless otherwise designated by the chairman.

Section 4. The board has all powers provided in Section 59-19-90 of the 1976 Code insofar as they may be applicable. It may use any school building without cost in wither school district available for its purposes. It may direct the county auditor to levy taxes to operate the school, to construct buildings, and to pay the expenses of the school if approval is first obtained from the county commission for any such tax levy.

Section 5. The board shall employ a director of the center who shall serve as supervisor and fiscal agent of the school under the direction of the board.

Section 6. If the board shall become the owner of any property, each school district shall have an equal equity in the property.

Section 7. The trustees of each school district may assign pupils to the school when in the judgement of the respective boards any pupil in its district may be provided a better opportunity in life by the assignment.

Section 8. In addition to all other powers and duties granted the board, it has the following powers and duties to:

(1) have a seal;

(2) sue and be sued

(3) grant certificates to pupils satisfactorily completing any prescribed course of study;

(4) accept gifts and grants, donations, devises, and bequests;

(5) operate the school for twelve months each fiscal year and establish a fiscal year corresponding with the sate fiscal year;

(6) do any other act provided by law for the operation of public schools not inconsistent with the provisions of this act.

Section 9. This act takes effect upon approval by the Governor."
