AN ACT TO AMEND ACT 464 OF 1986, RELATING TO THE ADOPTION OF CHILDREN, SO AS TO PROVIDE FOR ADOPTION PROCEEDINGS IN PROGRESS BEFORE THE EFFECTIVE DATE OF THE ACT IN WHICH CONSENT OR RELINQUISHMENT HAS BEEN GIVEN FOR THE PURPOSE OF ADOPTION BEFORE THE EFFECTIVE DATE, WHETHER OR NOT A PETITION HAS BEEN FILED BEFORE THAT DATE, TO BE CARRIED TO CONCLUSION PURSUANT TO THE ADOPTION PROVISIONS OF THE CODE OF LAWS OF SOUTH CAROLINA, 1976, AS THEY EXISTED BEFORE THE EFFECTIVE DATE.

Be it enacted by the General Assembly of the State of South Carolina:

Effective date for adoption proceedings in progress

SECTION 1. Section 4 of Act 464 of 1986 is amended to read:

"Section 4. This act takes effect six months after approval by the Governor, except adoption proceedings in progress and not completed before the effective date of this act must be carried to conclusion pursuant to the provisions of Subarticle 7 of Article 11 of Chapter 7 of Title 20 of the 1976 Code, as the provisions existed before amendment by this act, unless the proceedings are otherwise revised by the family court to conform to the provisions of this act. 'Proceedings in progress' include proceedings in which consent or relinquishment has been given for the purpose of adoption before the effective date of Act 464 of 1986, whether or not a petition has been filed before that date."

SECTION 2. This act takes effect upon approval by the Governor.
