AN ACT TO CREATE THE UNION-LAURENS COMMISSION FOR HIGHER EDUCATION, TO PROVIDE FOR ITS MEMBERSHIP, DUTIES, AND FUNCTIONS, TO REPEAL ACT 23 OF 1965 RELATING TO THE UNION COUNTY COMMISSION FOR HIGHER EDUCATION, AND TO TRANSFER ALL ASSETS AND LIABILITIES OF THE UNION COUNTY COMMISSION TO THE UNION-LAURENS COMMISSION ABOVE ESTABLISHED.

Be it enacted by the General Assembly of the State of South Carolina:

Union-Laurens Higher Education Commission

SECTION 1. There is created the Union-Laurens Commission for Higher Education. This body is composed of seven members who must be appointed by the Governor upon the recommendation of a majority of the Union County and Laurens County Legislative Delegations, including the Senators meeting in joint session. The first members of this Commission must be the present members of the Union County Commission for Higher Education who shall serve until their current terms of office as members of the Union County Commission for Higher Education would have expired. At least five members of the Commission must be residents of Union County. The commissioners must be appointed for terms of four years each and shall serve until their successors are appointed and qualify. No member of the Commission may serve more than two consecutive four-year terms.

At their first meeting the commissioners shall elect a chairman, vice-chairman, secretary, and treasurer from among their members and proceed to organize and adopt rules and procedures to carry out their duties. The chairman of the commission must be a resident of Union County.

To facilitate its work the commission is authorized to appoint from Union and Laurens Counties and from those adjacent areas, as considered appropriate, an Educational Advisory Committee consisting of not less than ten nor more than fifteen members which shall meet and consult with the commission from time to time, as may be required. All members of the commission and of the Educational Advisory Committee shall serve without compensation or fees.

Meetings

SECTION 2. The commission shall meet at those times and in those places the majority of the members determine. Meetings may be called by the chairman of the commission or on the written request and signatures of three members. The commission's office must be located at the University of South Carolina at Union Campus.

Purpose

SECTION 3. The commission has as its purpose the encouragement of higher education in Union and Laurens Counties and adjacent areas and, more specifically, the establishment in Union and Laurens Counties of facilities to offer standard freshman and sophomore college courses and those other courses considered desirable.

Powers

SECTION 4. To carry out this purpose, the commission is empowered to enter into contracts, negotiate with educators and educational institutions, and, generally, to take those actions in its name as are necessary to secure for Union and Laurens Counties and adjacent areas the educational facilities above-described. The counties of Union and

Laurens are not bound nor held liable for any acts of omission or commission of the commission, nor by any provision of any contract, expressed or implied, except upon the written approval and consent of a majority of the legislative delegation, including the Senators of the county affected.

The commission may solicit funds and accept donations from various sources which it may expend in carrying out its objective.

Records

SECTION 5. The commission shall keep accurate and detailed records of its meetings and actions and shall, as soon after June thirtieth of each year as is feasible, submit a written report to the Union County and Laurens County Legislative Delegations, respectively, which must include an accounting of all funds the commission may have received and disbursed in the twelve months preceding that date.

Repeal and transfer

SECTION 6. Act 23 of 1965 is repealed and all assets and liabilities of the Union County Commission for Higher Education are transferred to the Union-Laurens Commission for Higher Education.

Time effective

SECTION 7. This act takes effect upon approval by the Governor.
