AN ACT TO APPROVE THE DISSOLUTION OF THE EAST CLEMSON WATER DISTRICT IN PICKENS COUNTY, TO PROVIDE FOR THE TRANSFER AND CONVEYANCE OF THE WATER SYSTEM OPERATED BY THE DISTRICT AND THE DISTRICT'S ASSETS TO THE CITIES OF CLEMSON AND CENTRAL, SOUTH CAROLINA, AND TO REPEAL ACT 128 OF 1953 RELATING TO THE ESTABLISHMENT OF THE EAST CLEMSON WATER DISTRICT.

Whereas, the East Clemson Water District in Pickens County, created by Act 128 of 1953, has been granted the authority to operate a water distribution system within the boundaries of the district; and

Whereas, a special election was held November 7, 1989, and a majority of the qualified electors of the East Clemson Water District voted in favor of authorizing the Commissioners of the East Clemson Water District to transfer and convey the East Clemson Water District's water distribution to the cities of Central and Clemson; and

Whereas, the East Clemson Water District is authorized by favorable referendum of a majority of the qualified electors of the district to dissolve the district and to transfer its water distribution system and related assets to the cities of Clemson and Central, South Carolina. Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

Property transferred

SECTION 1. The Commissioners of the East Clemson Water District owned and operated a water distribution system within the district. Pursuant to an agreement and the subsequent election, the Commissioners of the East Clemson Water District have transferred and conveyed the system and most of the related assets to the cities of Clemson and Central, South Carolina. These actions have been approved by referendum.

District to cease operation

SECTION 2. At such time as the East Clemson Water District transfers and conveys its remaining assets, as prescribed in this act, the East Clemson Water District shall cease to exist except for the purpose of winding up its affairs.

Offices abolished

SECTION 3. Upon the transfer and conveyance of the East Clemson Water District's water distribution system and its remaining assets, the Commissioners of the East Clemson Water District will have no further powers or duties except to wind up the affairs of the East Clemson Water District, and the offices held by the Commissioners of the East Clemson Water District are hereby abolished after all such matters have been completed. The Commissioners of the East Clemson Water District shall not make any obligations, either written or oral, which financially or otherwise further obligate the district. There may be no further elections held to fill a vacancy on the Board of Commissioners of the East Clemson Water District should a vacancy occur before the winding up of the affairs of the East Clemson Water District and the final dissolution of the district itself.

Councils to be notified

SECTION 4. After winding up the affairs of the East Clemson Water District, the commissioners shall notify the city councils of Clemson and Central that no further business remains to be transacted by the district and that there is no further need for the district to continue in existence. The final dissolution of the East Clemson Water District is effective when this notice is received by the city councils of Clemson and Central.

Repeal

SECTION 5. Act 128 of 1953 is repealed.

Time effective

SECTION 6. This act takes effect upon approval by the Governor.
