AN ACT TO AMEND SECTIONS 40-77-250, 40-77-260, 40-77-270, AND 40-77-290, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO GEOLOGISTS, SO AS TO CHANGE QUALIFICATIONS FOR CERTIFICATION OF GEOLOGISTS AND GEOLOGISTS-IN-TRAINING AND THE ISSUANCE AND RENEWAL OF CERTIFICATES AND RENEWAL OF REGISTRATION CARDS AND TO REPEAL SECTION 40-77-170 RELATING TO ELIGIBILITY FOR RECOGNITION IN A SPECIALTY.

Be it enacted by the General Assembly of the State of South Carolina:

Registration of geologists

SECTION 1. Section 40-77-250 of the 1976 Code is amended to read:

"Section 40-77-250. The board shall issue a certificate of registration, upon payment of the registration fee, to an applicant who has met satisfactorily all the requirements of this chapter. For a registered professional geologist, the certificate must authorize the practice of geology. For a geologist-in-training, the certificate must state that the applicant has been enrolled as a geologist-in-training. The certificates must show the full name of the registrant, have a serial number, and must be signed by the chairman and the secretary of the board under seal of the board."

Reexamination

SECTION 2. Section 40-77-260 of the 1976 Code is amended to read:

"Section 40-77-260. A candidate failing an examination may apply for reexamination at the next examination date and must be reexamined with payment of an additional fee sufficient to cover the cost of reexamination."

Certificates of registration

SECTION 3. Section 40-77-270 of the 1976 Code is amended to read:

"Section 40-77-270. The issuance of a certificate of registration by the board is prima facie evidence that the person named is entitled to all the rights and privileges of a registered professional geologist or geologist-in-training while the certificate remains valid."

Renewals

SECTION 4. Section 40-77-290 of the 1976 Code is amended to read:

"Section 40-77-290. Every registered professional geologist or geologist-in-training who, under the provisions of this chapter, decides to continue the practice of his profession may be issued annually or biannually a renewal registration card for the ensuing registration period upon payment of the prescribed fee. Each registrant shall continue to increase his knowledge of the practice of geology. In order to qualify for renewal of registration, the registrant must participate in continuing education activities during the period before renewal of registration and earn a minimum number of continuing education units. The kind of continuing education and the required number of units must be determined by the board."

Repeal

SECTION 5. Section 40-77-170 of the 1976 Code is repealed.

Time effective

SECTION 6. This act takes effect upon approval by the Governor.
