AN ACT TO AMEND ACT 784 OF 1964, AS AMENDED, RELATING TO THE LUGOFF WATER DISTRICT OF KERSHAW COUNTY, SO AS TO CHANGE THE PROCEDURE FOR SELECTING THE BOARD MEMBERS FROM APPOINTMENT BY THE GOVERNOR TO ELECTION BY THE USERS OF THE DISTRICT.

Be it enacted by the General Assembly of the State of South Carolina:

Board members, selection of, procedure changed

SECTION 1. Section 3 of Act 784 of 1964 is amended to read:

"Section 3. This district must be operated and managed by a board of directors known as the 'Lugoff Water District Board of Kershaw County' which constitutes the governing body of the district. The board shall consist of five resident users of the district who are also electors of the area. Board members must be nominated and elected at the annual meeting of the users of the district. Each user attending the meeting is entitled to one vote in each election. The meeting must be advertised in a local newspaper for at least one week giving the time and place of the meeting. All terms are for six years. Board members appointed to office before the enactment of this section shall serve until the expiration of their terms and until their successors are elected and qualified. A vacancy must be filled in the same manner as set forth in this section for the initial election of board members for an unexpired term. Immediately after their election, the board members shall meet and organize by electing one of its members as chairman, one as vice-chairman, one as secretary, and one as treasurer. The offices of the secretary and treasurer may be combined in the discretion of the board."

SECTION 2. This act takes effect upon approval by the Governor.
