AN ACT TO AMEND ACT 777 OF 1988, RELATING TO THE ESTABLISHMENT OF THE LANCASTER COUNTY SCHOOL DISTRICT, SO AS TO PROVIDE THAT A STATEMENT OF CANDIDACY FOR ELECTION TO THE DISTRICT BOARD MUST BE FILED NO LATER THAN THE FIRST DAY OF SEPTEMBER PRECEDING THE ELECTION RATHER THAN FORTY-FIVE DAYS BEFORE THE ELECTION AND TO PROVIDE THAT WHEN SEPTEMBER FIRST IS A SUNDAY THE STATEMENT MUST BE FILED BY NOON OF THE FOLLOWING MONDAY.

Be it enacted by the General Assembly of the State of South Carolina:

School board elections

SECTION 1. Section 6 of Act 777 of 1988 is amended to read:

"Section 6. All persons desiring to qualify as a candidate for election to the board of trustees shall file with the county election commission a statement of candidacy no later than the first day of September before the general election. If September first is a Sunday, the statement must be filed no later than twelve noon on the following Monday before the general election. The county election commission shall conduct and supervise all elections for members of the board in the manner governed by the election laws of this State, mutatis mutandi. The commission shall prepare a nonpartisan ballot to be used for the election of all members of the board which shall comply substantially with the provisions of Article 3, Chapter 13, Title 7 of the 1976 Code, appoint managers for the voting precincts, and do all things necessary to carry out the election, including the counting of ballots and declaring the results. The commission shall advertise the date of the election sixty days preceding the election in a newspaper of general circulation published in Lancaster County and shall publish a second notice two weeks thereafter. The members of the board of trustees shall take office upon the certification of their election."

SECTION 2. This act takes effect upon approval by the Governor.
