That the Department of Highways and Public Transportation is requested to change the name of Warren Street (S-141) in the Town of Hardeeville in Jasper County to John Smith Road.

Be it further resolved that a copy of this resolution be forwarded to J. G. Rideoutte, Executive Director, Department of Highways and Public Transportation.

Kirsh: A BILL TO AMEND CHAPTER 11, TITLE 26, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO NOTARIES PUBLIC, BY ADDING SECTION 26-1-95 SO AS TO MAKE IT ILLEGAL FOR A NOTARY PUBLIC IN HIS OFFICIAL CAPACITY TO FALSELY CERTIFY THE AFFIRMING OR SWEARING OF A PERSON TO AN INSTRUMENT, AFFIDAVIT, OR WRITING, TO PROVIDE A PENALTY FOR VIOLATION, AND TO REQUIRE A NOTARY PUBLIC CONVICTED UNDER THE PROVISIONS OF THIS SECTION TO FORFEIT HIS COMMISSION.

H. 3018 -- Rep. Clyborne: A BILL TO AMEND SECTION 18-7-20, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO AN APPEAL FROM A JUDGMENT IN A MAGISTRATE'S OR MUNICIPAL COURT, SO AS TO CHANGE FROM TEN TO THIRTY DAYS THE TIME AN APPELLANT HAS TO FILE HIS NOTICE OF APPEAL.

The Judiciary Committee proposed the following Amendment No. 1 (Doc. No. 0867U), which was adopted.

Amend the bill, as and if amended, by striking SECTION 2, page 1, and inserting:

/SECTION 2. Section 22-3-1000 of the 1976 Code is amended to read:

"Section 22-3-1000. No motion for a new trial shall may be heard unless made within five days from the rendering of the judgment. And the The right of appeal from the judgment shall exists exists for five twenty-five days after the refusal of a motion for a new trial."

SECTION 3. This act takes effect upon approval by the Governor./

Townsend: A BILL TO AMEND SECTION 16-11-740, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE OFFENSE OF MALICIOUS INJURY TO TELEGRAPH, TELEPHONE, OR ELECTRIC UTILITY SYSTEMS, SO AS TO INCLUDE INJURY TO CABLE TELEVISION SYSTEMS IN THE OFFENSE AND TO PROVIDE A SPECIFIC PENALTY FOR THE OFFENSE.

The Judiciary Committee proposed the following Amendment No. 1 (Doc. No. 0884), which was adopted.

Amend the bill, as and if amended, by striking SECTION 1 and inserting:

/SECTION 1. Section 16-11-740 of the 1976 Code is amended to read:

"Section 16-11-740. Any A person who, without the consent of the owner, willfully wilfully destroys, damages, or in any way injures any a telegraph, telephone, or electric utility system, or cable television system, including poles, cables, wires, fixtures, antennas, amplifiers, or other apparatus, equipment, or appliances; or obstructs, impedes, or impairs the service thereof, or the transmission of messages or current thereover their services or transmissions; or aids, agrees with, employs, or conspires with, any person to do or cause to be done any of the acts herein mentioned in this section is guilty of a misdemeanor and shall, upon conviction, must be fined or imprisoned in the discretion of the court."/
