The General Assembly of the State of South Carolina, begun and holden at Columbia on the second Tuesday in January, being the 9th day of the month.

Pursuant to the provision of the Constitution, the members of the Senate assembled this day in the Senate Chamber at 12 o'clock Noon.

The Senate was called to order by the PRESIDENT, the Honorable Nick A. Theodore.

Proceedings were opened with prayer by the Chaplain, the Reverend George E. Meetze, Columbia, as follows:

Dear Lord and Father of mankind: we've been

Committee To Inform The Governor

The PRESIDENT appointed Senators WILLIAMS, MATTHEWS, NELL W. SMITH and LEE to a committee to inform the Governor that the Senate had organized and was ready to proceed with business.

Committee To Inform The House

The PRESIDENT appointed Senators WADDELL, McLEOD, THOMAS and MITCHELL to a committee to inform the House of Representatives that the Senate had organized and was ready to proceed with business.

PRIVILEGE OF THE FLOOR

On motion of Senator WILLIAMS, with unanimous consent, the Privilege of the Floor was extended to the PRESIDENT of the Senate, for the purpose of addressing the body with brief remarks.

Upon the conclusion of the remarks of the PRESIDENT, Senator WILLIAMS was recognized and moved that the Senate proceed to the election of the Sergeant-at-Arms.

Election Of Sergeant-At-Arms

The PRESIDENT called for nominations for Sergeant-at-Arms.

Senator WILLIAMS nominated Mr. James R. Melton of Columbia.

Senators DRUMMOND, HOLLAND and MITCHELL seconded the nomination of Mr. Melton.

On motion of Senator HOLLAND, the nominations were closed and Mr. Melton was elected Sergeant-at-Arms of the Senate by acclamation.

Election Of Assistant Sergeant-At-Arms

The PRESIDENT called for nominations for an Assistant Sergeant-at-Arms.

Senator WADDELL nominated Mr. Roger W. Beaver of West Columbia.

Senator J. VERNE SMITH seconded the nomination of Mr. Beaver.

On motion of Senator SETZLER, the nominations were closed, and Mr. Beaver was elected Assistant Sergeant-at-Arms of the Senate by acclamation.

The PRESIDENT called for Petitions, Memorials, Presentments of Grand Juries and such like papers.

Whereas, Medicare was established by the federal government in 1965 for the purpose of creating a federal financing system that would provide elderly Americans with affordable access to health care services; and

Whereas, Medicare beneficiaries in South Carolina pay social security premiums equal to persons in all other states, yet receive significantly less in benefits; and

Whereas, the Medicare program originally contained features that provided "unusual, customary, and reasonable" reimbursement for services and minimized the program's impact on the then existing health care system; and

Whereas, the South Carolina Medical Association and the American Medical Association have encouraged the United States Congress to address an indemnity payment schedule, which reflects valid and demonstrable geographic differences in practice costs and is based on an appropriate relative value scale, as a more acceptable Medicare payment system; and

Whereas, it is important that the current funding level for Medicare is maintained; and

Whereas, the United States Congress should keep its promise to provide high quality health care for the nation's elderly and disabled; and

Whereas, it is especially fitting that Congress take this action on the occasion of Medicare's twenty-fifth anniversary. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the members of the General Assembly memorialize the United States Congress either to reduce South Carolina Medicare premiums or to equalize benefits to persons across the nation and to protect Medicare in its budget deliberations for Fiscal Year 1991.

Whereas, as the City of Charleston works to recover from the devastation of Hurricane Hugo, Mayor Joseph P. Riley, Jr., has rendered superb leadership at the forefront of this tremendous task and difficult undertaking; and

Whereas, on the eve of the hurricane, Mayor Riley actively began issuing directives to city officials and warning residents to take the necessary precautions for their safety and protection; and

Whereas, even though Hugo was extremely powerful and destructive, through excellent planning and preparation, the citizens of Charleston were able to survive the storm with minimal loss of life; and

Whereas, Mayor Riley did an outstanding job in coordinating and providing assistance to the residents of Charleston; and

Whereas, immediately he began consulting with national, state, and local officials to establish an emergency assistance plan for the city's residents; and

Whereas, through these efforts, the city has received much-needed assistance and aid from around the State and nation and from throughout the world; and

Whereas, not only has Mayor Riley through his hard work and diligence led the way for the safety and health of the citizens, he has through his character, speech, and representation of the city served as a model of inspiration and pride for all Charlestonians; and

Whereas, Joseph P. Riley, Jr., is one of the outstanding mayors in America and is greatly deserving of commendation for the wonderful job he has done in leading a hard-hit City of Charleston toward a magnificent recovery. Now, therefore,

Whereas, countless persons considered themselves Harry's friends, and he was a true friend to everyone he knew; and

Whereas, his loyalty, his kindness, and his professionalism endeared him to the members of the General Assembly, and we have lost a great friend whom we loved and admired very much; and

Amend the bill, as and if amended, by adding the following new sections to be appropriately numbered to read:

/SECTION ____. Section 38-1-20(9) of the 1976 Code is amended to read:

"(9)   'Casualty insurance' means every insurance against legal liability of the insured for bodily injury to or death of other persons, including workers' compensation insurance, and for damages to or loss or destruction of the property of others; medical payments insurance when written in conjunction with any insurance covering liability for the deaths or bodily injuries of others; guaranteeing the fidelity of persons holding positions of public or private trust; loss of or damage to property caused by burglary, theft, larceny, robbery, fraud, or any unlawful taking or secretion of property owned by or entrusted to the insured; loss of or damage to property of the insured resulting from the explosion of or damage to any fired or unfired boiler or other pressure vessel, engine, turbine, compressor, pump, wheel, any apparatus generating, transmitting, or using electric power, and any machinery or equipment connected with any of the foregoing; loss resulting from nonpayment of debts owed to merchants or other persons extending credit; and legal insurance.; and job protection insurance."

SECTION ____. The 1976 Code is amended by adding:

"Section 38-43-101. An agent of a casualty insurer who sells only job protection insurance as defined in Section 38-75-610 is not required to take the written examination required by Section 38-43-100."

SECTION ____.   Section 38-43-105(e) is amended to read:

"(e) This section applies to residents applying for a license to engage in the sale of insurance except those persons who have previously been licensed for a period of five years or more and those persons applying for a license limited to the following types of insurance only or a combination thereof:

(1)   credit life or credit accident and health;

(2)   credit property;

(3)   crop hail;

(4)   automobile physical damage;

(5)   mortgage guaranty or mortgage redemption, or both;

(6)   title;

(7)   travel accident and baggage;

(8)   federal crop insurance program;

(9)   job protection insurance."

SECTION ____.   Chapter 75, Title 38 of the 1976 Code is amended by adding:

"Article 8
Job Protection Insurance

Section 38-75-610. Job protection insurance means the business of providing monthly benefits to employees of the railroad industry or to bus drivers and truck drivers employed by common carriers for loss of wages arising from their discharge or suspension as a penalty or method of discipline imposed by the individual employer. Benefit funds administered by and through labor unions for their members are not considered job protection insurance."

SECTION ____. Coverages provided under job protection insurance are not subject to guaranty funds as may be provided under the laws of this State unless specifically indicated in the laws governing those funds./
