The Senate assembled at 12:00 Noon, the hour to which it stood adjourned and was called to order by the PRESIDENT.

A quorum being present the proceedings were opened with a devotion by the Chaplain as follows:

First Day of the Jewish Feast of the Passover

Beloved, in the Book of the Exodus, Chapter 12, verse 12, we read:

"For I will pass through the land of Egypt

this night, and will smite all the firstborn

in the land of Egypt both man and beast; and

against all the gods of Egypt I will execute

judgment: I am the Lord."
(NOTE: In the 430 years from Joseph to Moses, the 70 souls had grown to between 2 and 3 million. Such a demographic development involved in "the Exodus" staggers the modern imagination.)
Let us pray.

Blessed art Thou, O Lord our God, King of the universe, who at Thy word bringest on the evening twilight, with wisdom openest the gates of the heavens, and with understanding changest times and variest the seasons, and arrangest the stars in their watches in the sky, according to Thy will. Thou createst day and night; Thou rollest away the light from before the darkness, and the darkness from before the light; Thou makest the day to pass and the night to approach, and dividest the day from the night; the Lord of hosts is Thy name; a God living and enduring continually, mayest Thou reign over us forever and ever. Blessed art Thou, O Lord, who bringest on the evening twilight.

Help us toss the bitter herbs of our troubles into the sweet waters of Marah and show us the way to the Promised Land!

A person not wishing to say the 'Pledge of Allegiance' or otherwise participate in saying the 'Pledge of Allegiance' is exempt from participation and may not be penalized for failing to participate.

"Section 38-77-120.   (a)   No cancellation or refusal to renew by an insurer of a policy of automobile insurance is effective unless the insurer delivers or mails, to the named insured at the address shown in the policy, a written notice of the cancellation or refusal to renew. This notice:

(1)   Must be approved as to form by the Commissioner prior to use.

(2)   Shall state the date not less than fifteen days after the date of the mailing or delivering on which the cancellation or refusal to renew becomes effective.

(3)   Shall state the specific reason or reasons of the insurer for cancellation or refusal to renew.

(4)   Shall state the range of potential penalties to be paid to the State by individuals that fail to comply with the financial responsibility law.

(b)   Subsection (a) of this section does not apply:

(1)   If the insurer has manifested to the insured its willingness to renew by actually issuing or offering to the insured to issue a renewal policy, certificate, or other evidence of renewal, or has manifested such intention to the insured by any other means.

(2)   If the named insured has demonstrated by some overt action to the insurer or its agent that he expressly intends that the policy be cancelled or that it not be renewed.

SECTION 2.   This act takes effect upon approval by the Governor and applies with respect to cancellation notices made beginning one hundred eighty days after approval by the Governor./

Amend the bill, as and if amended, Section 4-9-195, as contained in SECTION 1, by striking subsection (B) beginning on page 2 and inserting:

/(B)   'Rehabilitated historic property' is eligible for certification if the following conditions are met:

(1)   the owner of the property applies for and is granted historic designation by the county governing body based on one or more of the following reasons:

(a)   the property is listed in the National Register of Historic Places;

(b)   the property is designated as an historic property by the county governing body and is at least fifty years old; or

(c)   the property is at least fifty years old and is located in an historic district designated by the county governing body;

(2)   the rehabilitation work is approved by the Department of Archives and History or its designee as appropriate for the historic building and the historic district in which it is located;

(3)   within two years after receiving the approval of the rehabilitation plans, the owner or his estate rehabilitates the building, with expenditures for rehabilitation exceeding fifty percent of the appraised value of the building in the case of owner-occupied property, or with expenditures for rehabilitation exceeding the appraised value of the building in the case of income-producing real property;

(4)   the owner or estate of any property certified as 'historic' takes no actions which cause the property to lose the qualities and features which made it eligible for certification. The Department of Archives and History or its designee shall have the authority to rescind approval of the rehabilitation work in these cases, and in this event the property becomes immediately ineligible for the special tax assessments provided for this type of property;

(5)   rehabilitation was commenced on the property after January 1, 1987./

Amend further, Section 4-9-195(C), as contained in SECTION 1, by adding the following new subitem appropriately numbered:

/( )   if the property qualifies as 'historic' as defined in subsection (B)(1)(a), (b), or (c), then the rehabilitation work must be approved by the Department of Archives and History as provided in subsections (B) and (D);/.

Amend further, Section 4-9-195, as contained in SECTION 1, by striking subsection (D) and inserting:

/(D)   The Department of Archives and History, or its designee, has the authority to approve rehabilitation work in the county as qualifying for the special tax assessment provided for 'rehabilitated historic property', and shall provide for procedures for application, consideration, and appeal through appropriate regulations. All requests for approval must be accompanied by a nonrefundable application fee of one hundred dollars. The fee must be deposited in the accounts of the Department of Archives and History, except that in counties where the department has delegated the approval responsibility to a local governmental agency or department, the local governmental agency or department shall receive the application fee./

Amend further, Section 4-9-195(E), as contained in SECTION 1, beginning on page 4, by striking item (3) and inserting:

/(3)   removal of the historic property designation by the county governing body;/.

Amend further, Section 4-9-195(E), as contained in SECTION 1, beginning on page 4, by adding the following new item appropriately numbered:

/( )   rescission of the approval of the rehabilitation work by the Department of Archives and History because of alterations or renovations by the owner or his estate which cause the property to no longer possess the qualities and features which made it eligible;/.
