A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-13-470 SO AS TO MAKE IT UNLAWFUL FOR A PERSON CONDUCTING A CONTEST TO FAIL TO GIVE A DETAILED DESCRIPTION OF THE PRIZES AND THE COSTS OF CLAIMING PRIZES IN ALL NOTICES OR OTHER COMMUNICATIONS TO PRIZEWINNERS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 13, Title 16 of the 1976 Code is amended by adding:

"Section 16-13-470. It is unlawful for a person conducting or sponsoring a contest, who notifies a resident of this State in writing or otherwise that the resident has won or is eligible to receive a prize, to fail:

(1) to provide in every communication with the resident concerning the prize a detailed description of the prize which the resident has won or is eligible to receive, including its fair market value; and

(2) to disclose fully the costs associated with claiming the prize, not including tax consequences.

A person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than one thousand dollars."

SECTION 2. This act takes effect July 1, 1992.
