(R415, S1347)

AN ACT TO AMEND ACT 902 OF 1964, AS AMENDED, RELATING TO THE CREATION OF THE ABBEVILLE COUNTY HISTORIC PRESERVATION COMMISSION, SO AS TO DELETE THE REQUIREMENT THAT MEMBERS OF THE COMMISSION MUST BE RECOMMENDED FROM CERTAIN MUNICIPALITIES, TO AUTHORIZE THE COMMISSION TO ELECT A SECRETARY AND TREASURER INSTEAD OF A SECRETARY-TREASURER, TO AUTHORIZE OFFICERS TO SUCCEED THEMSELVES UNDER CONDITIONS, AND TO SUBSTITUTE COUNTY COUNCIL FOR DELEGATION AS THE ENTITY WHICH MAY APPROPRIATE MONEY TO THE COMMISSION.

Be it enacted by the General Assembly of the State of South Carolina:

Composition of commission

SECTION 1. Sections 3 and 7 of Act 902 of 1964 are amended to read:

"Section 3. The commission is composed of seven resident electors of the county to be appointed by the Governor upon the recommendation of a majority of the Abbeville County Legislative Delegation. The terms of the directors are for four years or until their successors are appointed and qualify.

Immediately upon the appointment of the commission, it shall organize by electing a chairman, a vice chairman, a secretary, and a treasurer. The officers of the commission shall hold office for terms of two years and until their successors are chosen and qualify. However, with the voting approval of a majority of the members of the commission, the officers may succeed themselves for an additional term. It is the duty of the commission to see that a record of the appointees to the commission is filed in the clerk of court's office in Abbeville County, so as to indicate the persons holding office as members of the commission and the duration of their respective terms. No member of the commission may receive any compensation for his services as a member of the commission. Membership on the commission may not be construed to be an office of honor or profit. The treasurer must be bonded in the amount of one and one-half times the balance credited to the commission's bank account or its anticipated annual income. All expenditures must be by check signed jointly by the treasurer and the chairman.

Section 7. This commission and its operations must be financed by an appropriation to be made by the Abbeville County Council to become a part of the annual appropriations act for Abbeville County. This amount shall begin with the sum of six hundred dollars for the fiscal year 1964-65, and must be committed by the Abbeville County Appropriations Act for this fiscal year. Subsequent years must be financed by a sum to be agreed upon by the council and the commission."

Time effective

SECTION 2. This act takes effect upon approval by the Governor.

In the Senate House May 13, 1992.

President of the Senate
