TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 22-3-745 SO AS TO AUTHORIZE MAGISTRATES TO DISMISS CRIMINAL CASES FOR LACK OF PROSECUTION.
Amend Title To Conform
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 22-3-745. Magistrates and municipal judges may dismiss criminal charges for lack of timely prosecution provided that the prosecutor and defendant have been given ten days notice of the date, time, and location of trial."
SECTION 2. This act takes effect upon approval by the Governor.
