A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 26-1-55 SO AS TO REQUIRE POSTING A TEN THOUSAND DOLLAR BOND FOR A NOTARY COMMISSION TO BECOME EFFECTIVE AND TO PROVIDE AN EXCEPTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 26-1-55. (A) A commission issued pursuant to this chapter is not effective until a ten thousand dollar bond is filed with the Secretary of State. The bond must be executed by a licensed surety for a term of ten years with payment of bond funds to any person injured by the misconduct of the notary in carrying out the duties of a notary. The bond must begin on the date the commission was issued and terminate on its expiration date.

(B) A notary who is a public employee and who only uses this commission in the performance of official duties is not required to post the bond provided for in subsection (A)."

SECTION 2. This act takes effect three months after approval by the Governor.
