A BILL

TO AMEND SECTIONS 56-1-520 AND 56-5-6150, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE VESTING IN MUNICIPAL COURTS THE JURISDICTION TO HEAR, TRY, AND DETERMINE CRIMINAL CASES INVOLVING VIOLATIONS OF ARTICLE 1, CHAPTER 1, TITLE 56 (DRIVER'S LICENSE) AND CASES INVOLVING VIOLATIONS OF CHAPTER 5 OF TITLE 56 (UNIFORM ACT REGULATING TRAFFIC ON HIGHWAYS), SO AS TO INCREASE TRIAL JURISDICTION FOR MUNICIPAL COURTS FROM ONE HUNDRED TO TWO HUNDRED DOLLARS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 56-1-520 of the 1976 Code is amended to read:

"Section 56-1-520. The department shall administer and enforce the provisions of this article in general, and law enforcement officers generally shall also shall enforce applicable provisions within their respective jurisdictions. Recorders and municipal courts are hereby vested with all jurisdiction necessary to hear, try, and determine criminal cases involving violations of this article occurring within the corporate limits of such the municipalities where the punishment does not exceed a fine of one two hundred dollars or imprisonment for thirty days, the same as magistrates."

SECTION 2. Section 56-5-6150 of the 1976 Code is amended to read:

"Section 56-5-6150. All municipal courts of the State may try and determine criminal cases involving violations of this chapter occurring within the respective limits of such municipalities when the penalty prescribed by this chapter for such the violations does not exceed thirty days' imprisonment nor one two hundred dollars' fine and may have trial jurisdiction over such the criminal cases the same as magistrates."

SECTION 3. This act takes effect upon approval by the Governor.
