TO AMEND SECTION 43-5-540, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO WORK REGISTRATION REQUIREMENTS UNDER PUBLIC AID ASSISTANCE PROGRAMS, SO AS TO REVISE CERTAIN EXCEPTIONS TO THESE WORK REGISTRATION REQUIREMENTS; AND TO AMEND SECTION 43-5-550, RELATING TO A STATE PLAN FOR THE DESIGN, IMPLEMENTATION, AND OPERATION OF A WORK SUPPORT SERVICES DELIVERY SYSTEM, SO AS TO FURTHER PROVIDE FOR INDIVIDUAL EMPLOYABILITY PLANS WHICH MUST BE WRITTEN RESPONDING TO THE NEEDS OF EACH CLIENT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 43-5-540(a)(1) of the 1976 Code is amended to read:
"(1) a child for whom school attendance is required who is attending school or college or an approved program or vocational training on a full-time basis or who is under the age of sixteen, except that this exception does not apply to any child not otherwise required to attend school at least twelve years of age but less than sixteen who has not completed high school or its equivalent and who is not enrolled on a full-time basis in an approved program of vocational training or in an educational program geared to awarding a high school diploma or its equivalent if the child meets one of the following stipulations:
(1) is married or has been married;
(2) is unmarried and pregnant;
(3) has had a child outside wedlock; or
(4) is the custodial parent of a child not less than six weeks of age;".
SECTION 2. Section 43-5-550(h)(3) of the 1976 Code is amended to read:
"(3) Following assessment, an individual employability plan must be written responding to the needs of the clients. A vocational objective must be established for each client in keeping with identified abilities, aptitudes, competencies, and interests. Services must also be identified in the Plan plan which assist the client to enter employment. Support services such as substance abuse counselling and treatment, vocational rehabilitation counselling and treatment, parenting skills for young custodial parents, and living skills are required components for AFDC recipients whose individual employment plans prescribe these activities."
SECTION 3. This act takes effect upon approval by the Governor.
