TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 20-7-1515 SO AS TO REQUIRE THE COURT OR, IF THE JUDGE IS NOT IMMEDIATELY AVAIALABLE, THE CLERK OF COURT, UPON PRESENTATION OF A VERIFIED PETITION, TO ISSUE A RULE TO SHOW CAUSE CONCERNING THE VIOLATION OF A FAMILY COURT ORDER.
Amend Title To Conform
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 9, Chapter 7, Title 20 of the 1976 Code is amended by adding:
Section 20-7-1515. When a judge is not physically present in the courthouse during normal court hours, the clerk of court, upon presentation of a verified complaint, shall issue a rule to show cause on a form prescribed by the South Carolina Supreme Court directed to any party alleged to have violated an existing court order. The rule must require the alleged contemnor to appear at a time and date certain. The issuance of the rule to show cause is nondiscretionary."
SECTION 2. This act takes effect upon approval by the Governor.
