TO AMEND SECTION 11-35-710, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTIONS FROM PURCHASING PROCEDURES UNDER THE PROCUREMENT CODE, SO AS TO PROVIDE THAT GOVERNMENTAL BODIES EXEMPTED FROM THE PURCHASING PROCEDURES SHALL PURCHASE SOUTH CAROLINA PRODUCED AND PROCESSED PRODUCTS WHENEVER FEASIBLE AND IF THEY CHOOSE TO USE BIDDING PROCEDURES GOVERNED BY THE PROCUREMENT CODE THAT THE PROVISIONS OF SECTION 11-35-1520(9) APPLY IF THERE ARE TIE BIDS OR BIDS BY SOUTH CAROLINA VENDORS WHICH ARE WITHIN PERCENTAGES OF THE HIGH BID.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 11-35-710 of the 1976 Code is amended by adding at the end:
"Exempt governmental bodies shall purchase products produced and processed in South Carolina whenever feasible. If the governmental body opts to make purchases by competitive sealed bidding, the provisions of Section 11-35-1520(9) apply."
SECTION 2. This act takes effect upon approval by the Governor.
