TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 58-12-35 SO AS TO DEVOLVE THE DUTIES, FUNCTIONS, AND RESPONSIBILITIES OF COUNTY AND MUNICIPAL GOVERNING BODIES IN REGARD TO CABLE TELEVISION UPON THE PUBLIC SERVICE COMMISSION ON JULY 1, 1991, TO PROVIDE THAT THE COMMISSION SHALL REGULATE THE RATES CHARGED BY CABLE TELEVISION COMPANIES IN A CERTAIN MANNER, AND TO PROVIDE EXCEPTIONS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 58-12-35. The duties, functions, and responsibilities of county and municipal governing bodies under this chapter are devolved upon the Public Service Commission on July 1, 1991. However, the authority to allow installation of cable beneath public lands, roads, or waters, in Section 58-12-10, and the authority to require the moving or removal of cable from public lands, roads, or waters, in Section 58-12-20, is retained by the body having jurisdiction of the public lands, roads, or waters. The commission on this date also shall regulate the rates charged by cable television companies in the manner and under the terms and conditions it regulates the rates of telephone utilities under this chapter. After July 1, 1991, county governing body, municipal governing body, or similar derivations, used in this chapter where the context allows, mean the commission."
SECTION 2. This act takes effect upon approval by the Governor.
