A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 30-5-245 SO AS TO PROVIDE THAT A PERSON SUBDIVIDING REAL PROPERTY INTO FIVE OR MORE LOTS ONTO WHICH RESIDENTIAL HOMES OR COMMERCIAL BUILDINGS MAY BE CONSTRUCTED SHALL MEET CERTAIN REQUIREMENTS RELATING TO THE DRAINAGE OF EXCESS WATER ACCUMULATION BEFORE THESE LOTS MAY BE SOLD TO ANOTHER PERSON, AND TO PROVIDE PENALTIES FOR VIOLATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 30-5-245. (A) Any person subdividing a parcel of real property into five or more lots onto which residential homes or commercial buildings may be constructed first shall complete the following before any of these subdivided lots may be sold to another person:

(1) engage an independent consulting engineer for the purpose of conducting a study to determine an acceptable method or methods of removing surface water accumulation from the subdivision so that the property of adjoining landowners or homeowners will not be damaged by the accumulation;

(2) install one of the methods recommended by the consulting engineer;

(3) have the method selected approved before and after installation by the county or municipality in which the subdivision is located.

(B) Any person violating the provisions of subsection (A), in addition to any other civil remedies available to an injured party, is guilty of a misdemeanor and, upon conviction, must be fined not more than fifteen thousand dollars or imprisoned for not more than one year, or both.

SECTION 2. This act takes effect upon approval by the Governor.
