A BILL

TO AMEND SECTION 16-23-410, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO POINTING A FIREARM AT ANY PERSON, SO AS TO REVISE THE PENALTIES FOR VIOLATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 16-23-410 of the 1976 Code is amended to read:

"Section 16-23-410. It shall be is unlawful for any person to present or point at any other person any loaded or unloaded firearm and, upon conviction therefor, any such the person shall must be punished by fine or imprisonment for three years, in the discretion of the court. Nothing contained herein shall in this section may be construed to abridge the right of self-defense or to apply to theatricals or like performances."

SECTION 2. This act takes effect upon approval by the Governor.
