A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 11-9-115 SO AS TO REQUIRE CERTAIN PUBLIC NOTICES BEFORE A CONTRACT OR A LISTING AGREEMENT FOR THE SALE OF REAL PROPERTY OWNED BY THE STATE MAY BE EXECUTED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 11-9-115. No contract or listing agreement for the sale of real property owned by the State may be executed by a state agency, department, school, or entity having authority to sell the property until a notice of the agency's, department's, school's, or entity's intention to execute the contract or agreement, together with a description of the property, the proposed purchaser, if known, and the purchase price or asking price of the property has been published in a newspaper of general circulation in the county or counties wherein the property is located at least thirty days before the execution. This notice may not be published in the classified section of the newspaper."

SECTION 2. This act takes effect upon approval by the Governor.
