TO AMEND TITLE 42, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO WORKERS' COMPENSATION, BY ADDING SECTION 42-5-85 SO AS TO REQUIRE WORKERS' COMPENSATION INSURANCE CARRIERS TO MAINTAIN AND STAFF A CLAIMS OFFICE IN THIS STATE OR TO DESIGNATE AN INDEPENDENT CLAIMS FACILITY AND TO REQUIRE AN EMPLOYER TO MAKE THIS INFORMATION AVAILABLE TO EMPLOYEES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 5, Title 42 of the 1976 Code is amended by adding:
"Section 42-5-85. (A) All insurance carriers and self-insurers insuring the payment of compensation under this title must maintain and staff a claims office in this State open during normal business hours to serve insureds and employees of insureds on workers' compensation claims related matters or designate an independent claims facility to receive and process workers' compensation claims on their behalf. The designated claims facility chosen by a carrier or self-insured must be identified and registered with the South Carolina Workers' Compensation Commission as to which office of that independent facility is its processing facility.
(B) Every employer accepting the provisions of this title must provide to its employees the South Carolina address and telephone number of the carrier providing its workers' compensation coverage."
SECTION 2. This act takes effect upon approval by the Governor.
