AN ACT TO AMEND ACT 1377 OF 1968, AS AMENDED, RELATING TO THE AUTHORIZATION OF CAPITAL IMPROVEMENT BONDS, SO AS TO INCREASE THE INSTITUTION SIZE FROM EIGHT HUNDRED EIGHT TO ONE THOUSAND, ONE HUNDRED THIRTY BEDS IN THE MEDIUM SECURITY INSTITUTIONS TO BE CONSTRUCTED BY THE DEPARTMENT OF CORRECTIONS INSTEAD OF THE MEDIUM/MAXIMUM INSTITUTION PREVIOUSLY AUTHORIZED, AND TO PROVIDE THAT THE GENERAL ASSEMBLY INTENDS TO AUTHORIZE THE ADDITIONAL FUNDS TO COMPLETE THESE ENLARGED PENAL INSTITUTIONS IN LEGISLATION AUTHORIZING THE ISSUANCE OF ADDITIONAL CAPITAL IMPROVEMENT BONDS DURING THE 1991 SESSION OF THE GENERAL ASSEMBLY.

Be it enacted by the General Assembly of the State of South Carolina:

Institution size increased

SECTION 1. Sub-subitems (a) and (b) of subitem (1), item (f), Section 3, Act 1377 of 1968, as last amended by Act 622 of 1990, are further amended to read:

"(a) 1130-Bed Medium Security

Institution $26,600,000

(b) 1130-Bed Medium Security

Institution 26,600,000".

Legislative intent

SECTION 2. The State Budget and Control Board and the South Carolina Department of Corrections are directed to proceed with the two institutions identified in Section 1 of this act. The increase in the size of the institutions requires an additional $9,725,000 for each facility to be completed which totals $19,450,000. It is the intent of the General Assembly to provide these additional funds during the 1991 session of the General Assembly in legislation authorizing the issuance of additional capital improvement bonds.

Time effective

SECTION 3. This act takes effect upon approval by the Governor.

Approved the 20th day of March, 1991.
