AN ACT TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 14-17-725 SO AS TO PROVIDE THAT WHERE GENERAL SESSIONS FINES OR RESTITUTION PAYMENTS ARE PAID THROUGH INSTALLMENTS, A COLLECTION COST CHARGE OF THREE PERCENT OF THE PAYMENT ALSO MUST BE COLLECTED BY THE CLERK OF COURT FROM THE DEFENDANT AND TRANSFERRED TO THE COUNTY TREASURER FOR DEPOSIT TO CREDIT OF THE COUNTY GENERAL FUND.
Be it enacted by the General Assembly of the State of South Carolina:
Collection cost charge authorized
SECTION 1. The 1976 Code is amended by adding:
"Section 14-17-725. Where general sessions fines or restitution payments are paid through installments, a collection cost charge of three percent of the payment also must be collected by the clerk of court from the defendant and transferred to the county treasurer for deposit to credit of the county general fund in the same manner other funds collected by the clerk of court are transferred to the county treasurer for deposit to the county general fund."
Time effective
SECTION 2. This act takes effect upon approval by the Governor.
