TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 38-77-135 SO AS TO AUTHORIZE A PERSON TO SELF-INSURE UNDER CERTAIN CONDITIONS IF MORE THAN TWENTY-FIVE MOTOR VEHICLES ARE REGISTERED IN THAT PERSON'S NAME; TO AMEND SECTION 56-9-352, RELATING TO EXCEPTIONS TO THE REQUIREMENT THAT SECURITY BE DEPOSITED FOLLOWING MOTOR VEHICLE ACCIDENTS, SO AS TO REVISE THE EXCEPTION RELATED TO SELF-INSURERS; AND TO REPEAL SECTION 56-9-60, RELATING TO PERSONS OBTAINING CERTIFICATES OF SELF-INSURANCE FROM THE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 38-77-135. (A) A person in whose name more than twenty-five motor vehicles are registered may qualify as a self-insurer by obtaining a certificate of self-insurance from the commissioner as provided in this section. The commissioner, in his discretion, upon the application of the person, may issue a certificate of self-insurance when he is satisfied that the person is possessed and will continue to be possessed of ability to pay judgments obtained against him.
(B) Upon not less than five days' notice and a hearing pursuant to the notice, the commissioner, upon reasonable grounds, may cancel a certificate of self-insurance. Failure to pay a judgment within thirty days after it becomes final constitutes a reasonable ground for the cancellation of a certificate of self-insurance.
(C) If the commissioner cancels a certificate of self-insurance, he immediately shall notify the Department of Highways and Public Transportation of the cancellation, and it shall suspend the registration of the motor vehicles covered by the certificate unless the owner shows proof that he has obtained a motor vehicle liability policy for them.
(D) Any person who violates the provisions of this section is guilty of a misdemeanor and, upon conviction, must be fined not more than one hundred dollars or imprisoned for not more than thirty days."
SECTION 2. Section 56-9-352(4) of the 1976 Code is amended to read:
"(4) Any person qualifying as a self-insurer under Section 56-9-60 of this chapter Section 38-77-135;"
SECTION 3. Section 56-9-60 of the 1976 Code is repealed.
SECTION 4. This act takes effect upon approval by the Governor.
